Seventeen Republican lawmakers, including Montana’s Representative in the U.S. House are suing the Centers for Disease Control and Prevention over its mandate requiring masking on airplanes and public transportation.
Montana Rep. Matt Rosendale is among those who filed the lawsuit in a Kentucky federal court on Monday.
The lawsuit alleges that the CDC doesn’t have the authority to enforce the mandate because Congress never passed a law requiring masks on commercial flights.
The CDC says use of masks helps slow the spread of COVID-19.
Last month the CDC ended the requirement for masks on public school buses.
A federal mask mandate for airports, airplanes and other modes of public transportation was recently extended to April 18.
