BILLINGS, Mont. (AP) — A police officer shot and killed a man authorities said was waving a black pellet gun and threatening patrons inside a casino early Tuesday — the second fatal shooting by officers in Montana's largest city in less than 24 hours.

A federal appeals court has upheld a Montana law that says judicial candidates cannot seek, accept or use political endorsements in their campaigns.

The 9th U.S. Circuit Court of Appeals today upheld a U.S. District Court ruling that found Montana has compelling interests in an impartial and independent judiciary.

A legal settlement reached Friday could have a big impact on the future of Colstrip – both to the coal-fired power plant there, and the town itself.

Some renewable energy advocates say the settlement means the Colstrip plant could shut down sooner than had been anticipated – maybe as early as 2027, instead of sometime in the 2040s. But that depends on a lot of variables, and Colstrip’s backers say it could stay open for decades.

A legal settlement announced late Friday afternoon could send $10 million to the town of Colstrip to mitigate impacts from the partial shut down of the huge coal-fired power plant there.

"I think it’s a win for the town of Colstrip and a win for the state of Montana," says Eric Sell, a spokesman for Montana Attorney General Tim Fox.

The Montana Supreme Court has ordered a temporary stop to Marsy’s Law, the constitutional amendment approved by voters last fall.

The court halted Marsy’s Law, which increases the rights of crime victims, until another legal case challenging the constitutionality of new law is resolved. The constitutional amendment was scheduled to go into effect July 1.

Montana’s Attorney General today ruled Missoula cannot enforce an ordinance requiring gun sale background checks within the city limits.

The Missoula City Council passed the background check ordinance last September. Soon after, state House Speaker Austin Knudsen of Culbertson asked for Attorney General Tim Fox’s legal opinion on the matter.
